The ex-lawyer for the former president has left her position as New Jersey's top federal prosecutor. This comes after a legal ruling that questioned her legal standing to serve.

Attorney General's Statement

The head of the Justice Department, Pam Bondi, confirmed her stepping down on Monday. Bondi stated that the court's "flawed" ruling made it "untenable" for Habba to perform her duties.

"But do not mistake adherence to the ruling as defeat," Habba stated. "The effort will now extend throughout the country."

Court Ruling

The departure was triggered by a US appeals court found that she had been serving in violation of the law as US attorney. This judgment is expected to impact numerous legal proceedings in the state.

The court declared that a interim role that did not receive Senate approval violated the Federal Vacancies Reform Act.

Ongoing Legal Battle

It was also stated that she will remain at the justice department as a top consultant. She will challenge the decision of the ruling, aiming for a reversal.

On a social media platform, she wrote that judges "should not be able to countermand the appointment of attorneys responsible for performing the executive branch's core responsibility of enforcing the law."

The attorney general highlighted the prosecutor's work and said that during her run, the city of Newark saw a 20% reduction in criminal activity. Additionally that the Camden experienced its first summer in 50 years free from homicides.

Legal Career

Habba, 41, was initially recruited to Trump's personal legal team in recent years. Subsequently, she defended Trump in his New York criminal case in 2024, leading to his guilty verdict on dozens of charges of falsifying business records.
