Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her decision, the court pointed out that the authorities does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The court challenge center on conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.

The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
